HOA  declarations, bylaws, and covenants

1. Declarations

​

The Declarations are a set of legal obligations placed on the land by the developer and serve as an encumbrance that runs with the property. This means that these requirements are attached to the land itself and will affect any future owners, regardless of who occupies the home. While they are not part of the Homeowners Association (HOA), the Declarations establish that the property must be governed by an HOA and give an outline of the important elements to be incorporated into the HOA. Importantly, any changes to the Declarations can only be made with 100% agreement from all homeowners, ensuring that all voices are heard when it comes to significant alterations.

2. Bylaws of the Homeowners Association (HOA)

​

The bylaws provide the operational framework for the HOA. They detail how the association is governed, including the roles of board members, voting procedures, and meeting protocols. Unlike the Declarations, the bylaws can be amended through votes by HOA members, allowing for adaptability and responsiveness to community needs. Familiarity with these bylaws will empower you to participate actively in your community.

3. Covenants

​

Covenants are the rules and regulations set by the HOA that promote community standards and aesthetics. They cover various aspects such as property maintenance, landscaping, and home modifications. Like the bylaws, these covenants can also be changed through HOA member votes, ensuring that the community can evolve over time. Adhering to these covenants helps maintain the integrity and value of our neighborhood.
